1. Who we are
In short: You’re agreeing with Zenproducts Technology, an Indian company. Paddle sells the plans.
Octoque (octoque.com) is run by Zenproducts Technology Private Limited, a company registered in India (CIN U58201HR2026PTC146553), registered office Block B-400, 2nd Floor, Greenfield, NHPC Colony, Faridabad, Haryana 121010 (“we”, “us”). These terms are a contract between you and us. You accept them when you tick the box at sign-up or use Octoque.
If you use Octoque for a business, you accept these terms for that business and confirm you may do so. Where these terms treat consumers (people acting for purposes outside their trade or profession) differently from business customers, we say so.
Paid plans are sold by our reseller Paddle (Paddle.com Market Limited and its affiliates), which is the Merchant of Record for all orders. Paddle handles checkout, payment, tax and invoices under the Paddle Buyer Terms, and refunds follow our Refund Policy and Paddle’s Refund Policy.
2. Your account
In short: Be 18+, keep your login safe, and you’re responsible for your team and tools.
- You must be 18 or older (or the age of majority where you live, if higher). Octoque isn’t meant for children, and we don’t knowingly collect their data.
- Give accurate details and keep them up to date. Keep your password, sessions and API keys secret.
- You’re responsible for activity in your account and workspaces, including by team members you invite and AI assistants or tools you connect with an API key. Owners and admins choose what each team member can do.
- Tell us straight away at hello@octoque.com if you think someone has used your account without permission.
3. What Octoque does
In short: We publish to the platforms you choose. Platforms decide what they show; golden hours are estimates.
Octoque lets you upload a video, photo or text once, prepare it for each platform you connect (such as Instagram, Facebook, TikTok, YouTube, LinkedIn and X), and publish it now or at a time you pick or we suggest. We also show the results platforms report back.
- We publish through each platform’s official interfaces, directly or through service providers who work for us. You sign in on the platform’s own page; we never see your platform password.
- Platforms decide what they accept, show and keep. We can’t guarantee that a platform will publish a post, keep it up, or show it to anyone. If a post doesn’t go out, we tell you and help you retry.
- Suggested times (“golden hour”) and other insights are estimates from your past results and general patterns. They aren’t a promise of views, reach or income.
- AI features. If you use AI suggestions (for example caption ideas), check them before you post: they can be wrong, and you decide what goes out. Where the law requires AI-generated or AI-altered content to be labelled, you are responsible for labelling what you publish, and for following each platform’s rules on it.
- We keep Octoque secure and up to date and fix faults within a reasonable time. We may do maintenance; we try to schedule it so it doesn’t affect your posts.
4. Your content
In short: Your content stays yours. We only use it to run Octoque for you, and never to train AI.
You keep all rights in the videos, images, captions and other material you upload (“your content”).
You give us a worldwide, non-exclusive, royalty-free licence to store, copy, convert (for example, make a shorter copy when you ask us to trim a video for a platform’s limit), transmit and publish your content only to provide Octoque to you, for as long as we hold it. This licence ends when your content is deleted from Octoque. Posts already published stay on the platforms under their terms.
You confirm that you have all the rights and permissions needed for your content (including music, people who appear in it and brands), that it follows the law and each platform’s rules, and that you disclose paid partnerships and ads where the law or the platform requires it.
We don’t sell your content, don’t use it for advertising, and don’t use it to train AI models.
5. Rules and reports
In short: Post lawfully. If we act on your content, we tell you why and you can challenge it.
Our Acceptable Use Policy is part of these terms. In short: no illegal content, no content that infringes others’ rights, no spam or deception, no harassment, no harm to children, no malware, and no attempts to break, overload or get around Octoque or a platform’s limits.
How we moderate. We don’t review your content before it’s published. We act when we receive a report or an order from an authority, or when our automated checks spot abuse of the service (for example malware, spam patterns or unusual volume). People review every decision to remove content or restrict an account. We may remove or disable content, pause scheduled posts, or limit or close an account, choosing the least severe step that fixes the problem.
When we act on your content or account, we tell you why (the facts, the rule or law involved, whether automation was used, and how to challenge it), unless the law or an authority forbids it.
Reporting. Anyone can report illegal content, infringements or abuse with our report form or at hello@octoque.com. Copyright owners can send a notice, and users a counter-notice, through the same form (US rules under 17 U.S.C. §512 are set out in the Acceptable Use Policy). We confirm every report and tell the reporter what we decided.
Challenging a decision. You can ask us to look again at any decision about your content or account within 6 months, free of charge, through the complaint form. A different person reviews it and we tell you the outcome. You can also use any out-of-court or court route the law gives you.
Reminder. If you break these terms or the law, we may suspend or end your access and remove content; breaking the law may lead to penalties under the law that applies to you; and we report offences to the authorities where the law requires us to. We remind every user of this at least every three months.
6. Plans, trial and payment
In short: Free reminds you to post; it doesn’t post for you. No card for the trial, and it never charges you. Paid plans renew until you cancel, with a reminder 7 days before. When paid access ends, auto-posting stops after 7 days’ notice and nothing is deleted.
- Free plan. The Free plan costs nothing. You plan, write and schedule posts, and at each post’s time we send you a reminder with the caption and media ready; you post it yourself. The Free plan doesn’t post automatically. It covers reminders for up to 3 accounts and 10 posts a month, with no API access.
- Trial. New workspaces get a 14-day trial in which Octoque posts automatically to up to 3 accounts, with up to 30 posts in total for the trial and 10 X posts. It needs no card and never turns into a paid plan by itself. Each social account can be part of one free trial only. When the trial ends without a paid plan, the workspace moves to the Free plan; automatic posting stops 7 days later, and we email you before it does. Scheduled posts then become reminders. Nothing is deleted.
- Confirmed email. You need to confirm your email address before you connect an account that posts automatically.
- X posts. Each paid plan includes a monthly number of X posts. Because X charges far more for posts with a link, a post to X with a link counts as 10 X posts.
- Paid plans are billed in advance, monthly or yearly. The price, what’s included, the billing period and tax are shown before you pay. You agree to automatic renewal by choosing a paid plan at checkout.
- Automatic renewal. Your plan renews at the end of each period, at the price shown in the app, until you cancel. We email you 7 days before every renewal, with the amount, the date and how to cancel.
- Price changes never apply mid-period. We email you at least 30 days before a new price applies to your plan, and you can cancel before it does. Yearly plans keep their price until their next renewal.
- Payment, tax and invoices are handled by Paddle. Prices may include or add VAT, GST or sales tax depending on where you are, as shown at checkout. We never see your full card details.
- If a payment fails, Paddle will retry and we’ll email you. If it still fails, the workspace moves to the Free plan.
- When a paid plan ends (you cancel, it isn’t renewed, or a payment finally fails), the workspace moves to the Free plan. Automatic posting stops after 7 days’ notice by email, scheduled posts become reminders, and nothing is deleted: your posts, drafts, history and settings stay. Choosing a plan before then keeps automatic posting on.
7. Cancelling, withdrawal and refunds
In short: Cancel in two taps. Full refund within 14 days of any payment.
- Cancel any time, online, under You → Plan & billing. It takes two taps, as easy as signing up. Your plan runs to the end of the period you paid for and won’t renew; then the workspace moves to the Free plan as described in section 6. There’s no cancellation fee.
- Refunds. You get a full refund of any payment you ask about within 14 days of it. See the Refund Policy.
- EU and UK consumers: right of withdrawal. You may withdraw from a paid plan within 14 days of buying it, without giving a reason, using Withdraw from contract here or by sending us a clear statement (for example by email to hello@octoque.com). We confirm it by email straight away, and you get a full refund. We don’t charge for the days you used.
- Nothing in these terms limits refunds or remedies the law gives you, for example if Octoque doesn’t work as described.
8. Changes
In short: We tell you before anything important changes, and you can leave with a refund if you don’t like it.
To Octoque. We improve Octoque all the time. We only change features for a valid reason (such as a platform changing its rules, security, the law, or a better way to do something), and never charge you extra for a change. If a change makes your paid plan noticeably worse, we tell you in advance by email, and you may cancel within 30 days for a refund of the unused part of your payment. We never remove a feature you are paying for during a paid period unless a platform or the law forces us to; if that happens we’ll offer a fair remedy.
To these terms. For material changes, we email you and show a notice in the app at least 30 days before they take effect, and we remind you of our rules at least once a year. If you don’t agree, you can cancel and leave before the change applies, with a refund of any unused prepaid period. Other changes (such as clearer wording) take effect when published.
9. Leaving Octoque and taking your data
In short: Take all your data and files, free, whenever you like.
You can leave whenever you want, at no charge, and take everything with you:
- Export: under You → Privacy & data you can download, at any time and free, a file with your account, workspace, team, connected accounts, posts, captions, schedules, results and settings (JSON, a common machine-readable format), and a zip of all your uploaded files.
- Notice: cancelling takes effect at the end of your paid period; deleting your account takes effect at once. You never have to give more than that notice.
- Time to retrieve: after a paid plan ends, your data stays available on the Free plan; after you ask us to delete your account, we erase it as described in the Privacy Policy. If you’re moving to another service and need help or a longer transition (up to 30 days), write to us and we’ll keep things running and assist you.
- We don’t hold back any of your data, and we never charge switching or export fees.
10. Suspension and termination
In short: We only suspend for serious problems, warn you first where we can, and tell you why.
You can delete your account at any time under You → Privacy & data.
We may suspend or close an account, or a workspace, if it seriously or repeatedly breaks these terms or the law, puts others or Octoque at risk, or if an authority orders us to. Except in urgent cases or where the law prevents it, we warn you first and give you time to fix the problem and to export your data. We tell you the reasons and how to challenge the decision (section 5). If we close an account without a breach on your part, we refund the unused part of any prepaid period.
11. Connected platforms
In short: Each platform’s own rules apply too. If a platform takes away a feature you pay for, you can get money back.
When you connect a platform, you also agree to its terms, and you stay responsible for following them. By using Octoque’s YouTube features, you agree to be bound by the YouTube Terms of Service. The platforms’ terms include the YouTube Terms of Service, Instagram Terms of Use, Meta Terms of Service, TikTok Terms of Service, X Terms of Service and LinkedIn User Agreement. How YouTube data is handled is covered by the Google Privacy Policy.
Platforms can change or end their interfaces at any time, sometimes without notice. If that stops a feature from working, we’ll tell you and look for another way to keep it working. If a platform you rely on stops working with Octoque and we can’t restore it within 30 days, you can cancel and get a refund of the unused part of your payment. You can remove Octoque’s access to a platform at any time from Connected accounts or from the platform’s own settings.
12. Our software and feedback
In short: The software is ours; your ideas for it are welcome and free to use.
Octoque, its software, design and brand belong to us or our licensors. We give you a personal, non-transferable right to use Octoque under these terms while your account is open. Don’t copy, resell, or reverse-engineer it, except where the law allows. If you send us ideas or feedback, we may use them freely, without any obligation to you.
13. Our responsibility
In short: Consumers keep their legal rights. Businesses: our liability is capped at 12 months of fees.
If you are a consumer, you have legal rights about services that are faulty or not as described, and nothing in these terms affects them. We are responsible for loss or damage you suffer that is a foreseeable result of our breaking these terms or failing to use reasonable care and skill. We aren’t responsible for loss that wasn’t foreseeable, or for business losses.
If you are a business customer, to the extent the law allows: Octoque is provided “as is”; we aren’t liable for indirect or consequential loss, or for lost profit, revenue, followers, reach, goodwill or data that could have been exported; and our total liability for all claims in any 12 months is limited to the amount you paid us in the 12 months before the claim. You will compensate us for claims by third parties arising from your content or your breach of these terms or the law.
For everyone, nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, for gross negligence or wilful misconduct, or any other liability that can’t be limited by law.
Neither of us is responsible for delays or failures caused by events outside reasonable control (such as platform outages, internet failures, natural disasters or government action), as long as we take reasonable steps to limit the effect.
14. Law and disputes
In short: Indian law, but consumers keep their home-country protections and courts.
Please contact us first: most problems are solved fastest at hello@octoque.com. If you’re in India, you can also contact our Grievance Officer (section 16).
- Business customers: these terms are governed by the laws of India, and the courts at Faridabad, Haryana, India have exclusive jurisdiction.
- Consumers: these terms are governed by the laws of India, but you keep the protection of the mandatory laws of the country where you live, and you can bring a claim in the courts (or consumer forum) where you live. Consumers in India can approach the consumer commissions under the Consumer Protection Act, 2019. Consumers in the EU and UK can also use alternative dispute resolution bodies where available.
15. General
In short: These pages are the whole agreement, and the English version counts.
- These terms, the Acceptable Use Policy, the Refund Policy, the AI Terms, the Privacy Policy and, for business customers, the Data Processing Addendum (which applies automatically, with no signature needed) make up the whole agreement between us about Octoque.
- If a court finds part of these terms invalid, the rest still applies. If we don’t enforce a right straight away, we can still enforce it later.
- You may not transfer your account or these terms without our consent. We may transfer them to a company that takes over Octoque, and will tell you; your rights stay the same.
- We send notices to your account email or show them in the app. You can reach us at the addresses below.
- These terms are written in English, and the English version is binding. Translations are for convenience.
